Agreement to Terms

By downloading, installing, or using WarpWave ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

Description of Service

WarpWave is an iOS camera app that provides real-time visual effects (including Warp, Waterfall, Mirror, and BG+Scan modes), a social dueling feature called WarpDuel, and an AI-powered image compositing feature called AI Crossover. The App is available as a free download with optional in-app purchases.

Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly provide the App to children under 13.

Your Content

You retain full ownership of all photos, videos, and other content you create using the App ("Your Content"). WarpWave does not claim any ownership rights over Your Content.

By using the WarpDuel and AI Crossover features, you grant WarpWave a limited, temporary license to process Your Content solely for the purpose of delivering the requested feature (generating a battle card or AI composite image). This processing is automated, and Your Content is not reviewed by humans or used for any other purpose.

Acceptable Use

You agree not to use the App to:

• Create, share, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content that exploits or harms minors in any way
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the App to harass, bully, or intimidate other users through duels or shared content
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying technology
• Interfere with or disrupt the App's infrastructure, servers, or networks
• Use automated systems, bots, or scripts to interact with the App
• Circumvent any usage limits, content moderation, or access restrictions

WarpWave reserves the right to remove content and restrict access to users who violate these terms.

WarpDuels

WarpDuels are shared experiences between two users. By participating in a duel, you understand that your submitted scan will be visible to the other participant via a battle card. Duels expire automatically and are deleted from our systems within 7 days of expiration.

You are responsible for any content you submit through a duel. Do not submit content that you would not want another person to see.

In-App Purchases

WarpWave Pro is an optional subscription that unlocks premium features including the ability to send duels, premium filters, and watermark-free saves. Subscription pricing and terms are displayed in the App at the time of purchase.

AI Crossover Credits are consumable in-app purchases that allow you to generate AI composite images. Credits are non-refundable once used.

All purchases are processed through the Apple App Store. Billing, renewals, and refunds are handled by Apple in accordance with their terms and conditions. To request a refund, contact Apple directly through the App Store.

Content Moderation

WarpWave may use automated systems to review content submitted through the AI Crossover feature for compliance with our acceptable use policy and OpenAI's content policies. Content that is flagged by moderation systems may be rejected or removed without notice.

Intellectual Property

The App, including its design, code, visual effects, branding, and all related intellectual property, is owned by WarpWave and is protected by copyright and other applicable laws. You may not copy, modify, distribute, or create derivative works based on the App itself.

The WarpWave name, logo, and associated branding are trademarks of WarpWave. You may not use them without prior written permission, except to share or reference content you have created with the App.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. WarpWave does not guarantee that the App will be uninterrupted, error-free, or free of harmful components. You use the App at your own risk.

AI Crossover results are generated by third-party AI systems and may produce unexpected, inaccurate, or imperfect output. WarpWave does not guarantee the quality, accuracy, or appropriateness of AI-generated content.

Limitation of Liability

To the maximum extent permitted by applicable law, WarpWave and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the App, regardless of the theory of liability.

In no event shall WarpWave's total liability exceed the amount you have paid for in-app purchases in the twelve (12) months preceding the claim.

Termination

You may stop using the App at any time by uninstalling it. WarpWave reserves the right to suspend or terminate your access to the App at any time, for any reason, without prior notice — including for violation of these Terms.

Upon termination, your right to use the App ceases immediately. Any active duels or pending AI Crossover results may be deleted.

Changes to These Terms

WarpWave may update these Terms from time to time. If we make material changes, we will notify users through an update to the App. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in California.
